New York Attorney General Letitia James is under fire after being named special prosecutor in the explosive Cornell University fraternity scandal. The case involves a "Jane Doe" who filed a massive lawsuit alleging she was raped by seven fraternity brothers at the school’s Phi Chi house back in October 2024.
Why critics are skeptical
Critics—including various politicians and legal experts—are arguing that James is way too biased to handle this objectively. The drama stems from social media posts James made expressing sympathy for the accuser just days before Governor Kathy Hochul tapped her to lead the investigation.
Rensselaer County Executive Steven McLaughlin, who was previously prosecuted by James, claimed the "Cornell Seven" shouldn't expect a fair shake, calling James's track record "targeted political hits." Similarly, Staten Island City Councilman Frank Morano argued that James appears to have made up her mind before even getting all the facts. Even Melissa DeRosa, a former aide to ex-Governor Andrew Cuomo, suggested that Hochul’s move was just a "political solution to a media storm," and that an independent outsider should have taken the lead instead.
The case background
This all started when the victim filed a 101-page lawsuit claiming she was drugged with alcohol and ketamine before being sexually assaulted for hours. The suit alleges that while the assault was happening, one of the men sent a message to a massive fraternity group chat announcing "free p–sy" in the house.
While Cornell did run an internal Title IX investigation involving 12 hearings, the victim’s legal team claims the school’s response was a slap on the wrist—only two of the seven men were expelled. The case had previously gone cold without further prosecution, largely because not all evidence was shared with local law enforcement at the time.
Why it matters
Governor Hochul has publicly stated she has "every confidence" in James, but with high-profile voices questioning the integrity of the process, the case is becoming as much about the prosecutor as it is about the alleged crimes. It’s giving major tension, and everyone is waiting to see if James can actually deliver a fair outcome or if the vibes are off for the entire legal proceeding.
