The Incident
A tragic situation in a Tampa gated community has ended with no criminal charges filed against a local resident. The incident occurred on September 20, when 15-year-old Heitor Amaral and two friends went to an apartment complex on River Willow Place to search for a lost cellphone using tracking tech.
According to the Tampa Police Department, the group entered the community through an open gate and moved their truck when asked. They then began knocking on doors to look for the phone. Eventually, the teens reached an enclosed back patio and banged on a glass sliding door.
The Confrontation
Police report that the resident, a man in his mid-20s, put on a mask and armed himself to scare the teens. As two of the boys fled, a physical altercation allegedly broke out between the resident and Amaral. The shooter told investigators that Amaral put him in a headlock, which led him to fire a single shot. Amaral died from his injuries at the scene.
Following a review of the evidence, the state’s attorney’s office determined they could not refute the man's claim of self-defense.
Conflicting Accounts
There is a major disconnect between the official findings and the accounts from the teens' families. Yessenia Gonzalez, whose 16-year-old son was with Amaral, insists there was no fight and that the boys were unarmed and fleeing before the shot was fired. She claims her son described the shooter as acting as if he "had a new toy" and appeared ready to use his weapon.
Maysa Amaral, the sister of the victim, describes her brother as a "good kid" who was just starting his freshman year of high school. She and her family are grieving, and a GoFundMe has been established to assist with funeral costs and legal fees.
