A tragic Sunday morning in Queens

The neighborhood of Murray Hill is reeling after a horrific incident this past Sunday morning. Around 8:30 a.m., a white Chevrolet Silverado reportedly blew through a stop sign on 32nd Avenue, changing a family's life forever. The driver, identified as 57-year-old Elvin Rivera, struck a nanny and a 1-year-old baby named Justin Hu who was in a stroller.

Emergency responders rushed both victims to a nearby hospital, but tragically, baby Justin was pronounced dead. His nanny was also injured in the collision, sustaining an injury to her right arm.

The investigation

Following the crash, prosecutors allege that Rivera had traces of cocaine and THC in his system. He also failed a field sobriety test at the scene. Real talk: the plot thickens even more because Rivera already had an open DWI case stemming from an incident in the Bronx back in April.

Queens District Attorney Melinda Katz called the loss of Justin "completely avoidable," emphasizing that her office is committed to seeking justice for the family.

Legal aftermath

Rivera was arraigned on Monday and faces a long list of charges, including manslaughter, vehicular manslaughter, assault, driving while impaired, reckless driving, and driving without a license. He has pleaded not guilty and is currently being held without bail by Judge Michael Katz. If he’s convicted of the top charge, he’s looking at up to 15 years in prison. He is scheduled to return to Queens Criminal Court on Oct. 19.

Why it matters

This devastating event highlights the lethal consequences of drugged and reckless driving, especially as it involves a repeat offender. It’s a sobering reminder that road safety is a massive W for the whole community and when the vibes are this off, innocent lives end up paying the ultimate price.
