The Case So Far
Lee Gilley, 39, is currently sitting in a jail cell in Turin, Italy, following an extradition battle that has left even his veteran attorney stunned. Gilley is accused of murdering his wife, 38-year-old Christa Bauer Gilley—who was nine months pregnant at the time—in their Houston home back in October 2024.
Before his trial could even begin, Gilley allegedly cut off his ankle monitor and fled the U.S. for Italy this past May. Dick DeGuerin, a criminal defense attorney with 60 years of experience who is now representing Gilley, admitted that while he’s seen clients skip bond before, "I’ve never had one like this."
Why Italy Won't Let Him Go
Things got complicated when Italian courts blocked the initial U.S. request to bring Gilley back to Texas. The reason? Italy has a hard stance against extraditing suspects if the death penalty is on the table.
Since the charge against Gilley is capital murder, which could carry the death penalty or life without parole in Texas, Italian judges demanded official, written guarantees. On September 18, Harris County prosecutors officially dropped the death penalty to appease the Italian court's requirements. However, the drama isn't over. Italian authorities are now raising concerns about the possibility of life without parole, and they’ve asked for further clarification. The U.S. government has until September 30 to respond before an October 7 status conference determines the next move.
Through it all, DeGuerin maintains his client’s innocence, stating, "We’ve maintained from the very beginning that he is not guilty and he did not kill his wife."
